1. The Tenant warrants that the subjects
let are to be used for the purposes of a holiday and so accepts that the
letting is a holiday let to which Section 12(2) and paragraph 8 to Schedule 4
of the Housing (Scotland) Act 1988 apply, namely, "a tenancy the purpose
of which is to confer on the tenant the right to occupy the house for a
holiday."
2. The Tenant shall not sub-let the
premises or any part thereof.
3. The number of people occupying the
premises shall not exceed the number stated for the premises: 8 Adults for Burnside House and 4 Adults for Knockan
Crag Cottage.
4. The Tenant binds and obliges himself to
vacate the hired premises without demand at the termination of the period of
hire.
5. The Tenant binds and obliges himself to
pay to the lessor in respect of any loss or damage beyond fair wear and tear.
6. A deposit of £100 is
required to confirm a booking. The balance of the rent must be paid 30 days
before the start of the booking.
It should be clearly
understood that there is only a contract between the parties once the deposit
has been paid and that, unless and until the deposit has been paid and received, the lessor has the option to lease the property to someone else.
7. Cancellation - There will be a £50 cancellation admin fee.
The remaining £50 of the
deposit will be forfeit if the cancellation is less than 60 days before the
start of the booking. The Hirer also agrees that in this event (Cancellation
within 60 days of the start of the booking) while every effort will be made by
the lessor to re-let, if a substitute cannot be found, the Hirer will be
responsible for paying for the period of tenancy booked.
8. The lessor may treat the booking as
cancelled if the balance of the payment is not sent by the date agreed in the
booking agreement, and every effort will be made to re-let the vacancy.
9. The Hirer shall, at all times keep the
hired premises in a clean and tidy condition.
10. The Hirer shall undertake to prevent
any member of his party from causing a nuisance or disturbance to other
residents or occupiers in the neighbourhood. In the event of a problem arising,
the Landlord has the right to ask the Tenant to leave.
11. The Hirer undertakes
to leave the hired premises secure if left unoccupied during the period of let
and do nothing else which might vitiate the Landlord’s Insurance Policy.
12. The Hirer undertakes
to relieve the lessor from any liability for damage of injury however caused by
any member of his party.
13. The Lessor, his agents
or employees, accept no responsibility for loss, injury or damage to any member
of the Hirer's party or their property, howsoever caused, arising in any manner
out of the let of the premises.
